You acknowledge that TEAMPHORIA, in its sole discretion, may update or modify this Privacy Policy, and/ or any other posted policies, guidelines or rules from time to time. If substantial changes are made to this Privacy Policy, we will post the updated Privacy Policy on this page with the updated revision dateand we will notify you of the said changes using the contact details you have provided us with. Your continued use of the Service will be deemed consent and agreement to such updates and/ or modifications.

SCOPE.

This Privacy Policy describes how TEAMPHORIA and its affiliates (collectively, “TEAMPHORIA”) will use and share the Personal Information (defined below) collected when you visit or use the TEAMPHORIA website, products, software, application websites and mobile platforms/ applications that contain a link to this Privacy Policy (collectively the “Service”). This Privacy Policy describes (i) what Personal Information we collect, (ii) how we use and share your Personal Information, and (iii) your choices and obligations under this Privacy Policy in connection with your Personal Information.

“Personal Information” is information about you that is personally identifiable to you, like your name, address, email address or phone number, history of your use of the Service, your transmissions, messages, feedback, and communications that have passed through the Service, as well as other non-public information that is associated with the foregoing.

This Privacy Policy does not apply to websites, applications or mobile platforms that are not linked to this Privacy Policy or to those operated by third parties. This Privacy Policy does not extend to anything that is inherent in the operation of the Internet and therefore beyond our control, and is not to be applied in any manner contrary to applicable law or governmental regulation.

When you create a TEAMPHORIA account, the types of Personal Information that the Service collects directly from you include the following:

  • Payment information
  • Education and employment information
  • Comments and feedback
  • Interests and communication preferences

The Service also collects any other types of Personal Information that TEAMPHORIA expressly asks you to enter and submit to the Service.

The Service automatically collects certain information regarding your use of the Service, such as the following:

  • Computer, device and connection information, such as browser type and version, operating system, mobile platform, and unique device identifier and other technical identifiers
  • Uniform Resource Locator (URL) click stream data, including date and time, and content you viewed or searched for on the Service

We may use and disclose automatically collected information for any purpose, except where restricted by applicable law, specifically pertaining to data protection legislation. If we combine any automatically collected information with Personal Information, we will treat the combined information as Personal Information.

We may use aggregate information, which does not identify specific individuals, for any purpose.

C. COOKIES AND ANONYMOUS IDENTIFIERS

The Service may also automatically collect information through the use of cookies or similar technologies. A cookie is a small amount of data that is sent to and stored on your computer or mobile device by a website that you visit. Cookies enable member registration, login, and personalization, among other things. USE OF INFORMATION.

We use the Personal Information collected through the Service to provide, maintain and improve the Service. In addition to some of the specific uses described in this Privacy Policy, we may use this information to complete the following actions:

  • To update you on relevant new services and benefits
  • To contact you regarding our products and services or other products and services from third parties
  • For data analysis, audits, developing new products, enhancing the Service, identifying usage trends and determining the effectiveness of our promotional campaigns or in other ways to which you have expressly agreed in a customer agreement with us

DATA RETENTION

Use of Teamphoria is subject to our Terms of Service or other signed agreements between a client (Organization) and Teamphoria. Teamphoria may retain Organization data as long as necessary to provide Services to Organization. Organization administrators and Users may request their information to be deleted from Teamphoria. Data for closed Organization and/or User accounts may also be anonymized or deleted periodically. Users and Organizations may submit data deletion requests to support@teamphoria.com. Data deletion requests are carried out within 30 days.

SHARING OR DISCLOSING OF INFORMATION.

We share only your Personal Information in the following limited circumstances.

  • Agents, Representatives, and Business Partners. Your Personal Information may be accessible to our agents, representatives, and business partners for which we are acting as an agent, licensee, joint venture or publisher.
  • Service Providers. Your Personal information may be accessible to our service providers and suppliers, which assist us with producing and delivering the Service, operating our business, and marketing, promotion and communications. These providers and suppliers include, for example, credit card processors, customer support, email service providers, IT service providers and shipping agents.
  • Subscribers. If you access the Service through an employer-sponsored subscription, your Personal Information and certain usage data gathered through the Service, such as the number of items you downloaded and Content you accessed, may be shared with your employer for the purposes of usage analytics and Subscription management.
  • Other Third Parties. We may share Personal Information with other third parties if we expressly told you about such potential disclosure at the point at which you submitted the information to us.
  • Compliance with Law and Similar Obligations. We may share Personal Information in order to (i) respond to or comply with any law, regulation, subpoena or court order; (ii) investigate and help prevent security threats, fraud, or other malicious activity; (iii) enforce and protect the rights and properties of TEAMPHORIA; and (iv) protect the rights or personal safety of our employees and third parties on or using our property.
  • Change in Corporate Circumstances. If TEAMPHORIA, the Service or a related asset or line of business is acquired by, transferred to or merged with another company, your Personal Information may be disclosed to the prospective or actual purchaser. The Service also may provide access to message boards, discussion forums, profile pages, or other services to which you are able to post Personal Information and materials. Any information you post or disclose through these services is public, and you should exercise caution when disclosing Personal Information in any such public areas.

SECURITY.

We take reasonable security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of information. These include internal reviews of our information collection, storage and processing practices and security measures, including reasonable encryption and cyber security measures to guard against unauthorized access to systems where we store Personal Information.

We restrict access to Personal Information to our employees, contractors and agents who need to know that information in order to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Notwithstanding anything to the contrary, the foregoing does not restrict, limit, or supersede the warranties and disclaimers in the Terms of Service.  

PRIVACY PREFERENCES.

You can manage available communication preferences when you register with the relevant Service, by updating your account preferences, or, where applicable, by using the “opt-out” or unsubscribe mechanism or other means provided within the communications that you receive. We reserve the right to notify you of changes or updates to the Service whenever necessary.  

ACCESSING AND UPDATING PERSONAL INFORMATION.

When you use any of our Service, we will provide you with access to your Personal Information and either to correct this information if it is inaccurate or to delete such information at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask each individual user to identify himself or herself and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.  

ENFORCEMENT.

We comply with the EU-US Privacy Shield as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information.

When we receive formal written complaints, it is our policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between TEAMPHORIA and one or more individual users.
